- What do title companies do? A title company coordinates the interests of all parties involved in a real estate transaction by clearing title and preparing for settlement. Briefly, that includes: ordering an abstract; ordering a survey (if needed); verifying and paying off loans and property taxes, HOA fees, FFA obligations, judgments, ground rent, etc.; issuing title commitments/policies; preparing for settlement; conducting the closing; and recording documents.
- What is an Owner’s Title Insurance Policy (OTIP), and why do buyers need it? Owner’s title insurance protects the buyer against defects or liens against the title to the land and its improvements. For example, it protects against such things as mistakes in the public records, a forged will or deed, a title transfer by a minor, fraudulent conveyances or impersonations, identity theft, secret marriages, undisclosed heirs, invalid divorces, false affidavits, and other issues. How often do these come up? Honestly, we see them result in title claims more often than you might think. Most title claims result from unforeseen title defects. Fortunately, an OTIP is a one-time cost at time of purchase with no renewal premiums, is effective the day of settlement, and has no expiration date.
